Terms of business

These terms apply to every website project, change and hosting service provided by Second Fix. By accepting a quote you agree to them. If anything here conflicts with your written quote, the quote wins.

1. Who we are

Second Fix is a trading name of Damon O’Connell, 128 Mortimer Avenue, Old St Mellons, Cardiff CF3 6YF. Contact: hello@secondfixweb.co.uk.

2. Free homepage preview

The homepage preview is free and you’re under no obligation to go ahead. We keep the design of the preview. You may not publish or reuse it unless you go ahead with a project.

3. Quotes and scope

• Every project has a written fixed-price quote setting out the pages and features included.
• Quotes are valid for 30 days.
• Work outside the quote is priced and agreed with you in writing before it starts.

4. Payment

• A 50% deposit is due when you accept the quote. Work starts once it’s paid.
• The balance is due when you approve the finished site, before it goes live.
• The deposit covers work already started and isn’t refundable once the build has begun.
• Changes after launch are invoiced when they’re done, at the price we quoted.

5. Your content and responsibilities

• You confirm you have the right to use everything you send us, including logos, photos and text.
• You’re responsible for the accuracy of your business details, registrations and claims, and for following your accreditation schemes’ rules on logo use.
• If we haven’t heard from you for 60 days during a project, we may pause it and invoice for the work completed so far.

6. Amendments

Two rounds of amendments are included. A round is one list of changes sent together. Further rounds are quoted before they’re done. Mistakes on our part are always corrected free.

7. Ownership

• Once the balance is paid, you own your site’s design, text and images as delivered to you.
• We keep the right to reuse our underlying code, layouts and techniques on other projects.
• Your domain name is registered in your name and stays yours.
• We may show your site in our portfolio unless you ask us not to.

8. After launch: hosting and changes

• We host your site and its security certificate free of charge. We may end free hosting by giving you 60 days’ notice, and we’ll send you the site files so you can move it.
• Your contact form is set up on a form service account in your name, so enquiries go straight to you.
• Changes of up to 30 minutes cost £40. Larger changes are quoted separately. We always confirm the price before we start.
• We aim to reply to change requests within a few working days. There’s no monthly fee or minimum.
• Renewing your domain name is your responsibility, as it’s registered in your name.

9. Search and availability

We set your site up following good practice for search engines, but we can’t guarantee rankings, traffic or enquiries. We use reputable hosting but can’t guarantee the site will never be unavailable.

10. Liability

Our total liability for any project or service is limited to the fees you’ve paid us in the 12 months before the claim. We aren’t liable for lost profits, lost business or indirect losses. Nothing in these terms limits liability that can’t be limited by law.

11. Law

These terms are governed by the law of England and Wales.
